When someone dies without making a Will, it is called dying ‘intestate’. In such cases their ‘estate’ – their money, property and possessions – are divided up according to statutory rules. These rules are complex, and may not necessarily reflect that person’s wishes for what should happen to their estate when they have passed away.
A Will is a legally binding document stipulating how you wish your estate to be divided up after your death. It can be changed at any time according to your circumstances, so should be reviewed from time to time.

In your Will you can state whether you want to be buried or cremated, and you can choose your ‘executor’. This is the person who will deal with your estate and any other wishes laid down in your Will.
They will need to apply for Probate in order to be awarded a Grant Of Representation. This is a document legally entitling the executor to dispose of the estate in accordance with the Will. They must also work out whether the estate is liable to Inheritance Tax or Capital Gains Tax.
